The Village Court is a part of the Unified Court System of New York State and has both civil and criminal adjudication powers in cases of original jurisdiction. Jury and non-jury cases can be held in the Village Courtroom. Village justices are elected in 4-year terms. In criminal proceedings they arraign defendants, set bail, issue orders of protection, hold felony and other preliminary hearings and sentence defendants. The Court Clerk is responsible for maintaining all Court related records.
The Village court has jurisdiction over the following matters:
• Criminal offenses committed within the Village
• Original civil actions up to $3, 000.00; civil actions up to $5,000.00 when transferred from County or Supreme Court
• Small claims up to $3,000.00
• Traffic and parking offenses committed within the Village
• Landlord/tenant proceedings
• Violation of Village Ordinances/State codes

While the State has granted this Village Court the above powers, the Village Court of Head of the Harbor does not exercise most of these jurisdictions. Please check with the Court Clerk's office. The Village Court and the Court Clerk's office are located in the Village Hall. The Court is in session the third Thursday of every month at 6 PM. Fines for parking and moving violations can be paid in the Court Clerk's office or by mail. Contested tickets are heard during Court sessions.
